ACTIVE

This presentation, designed for independent patient advocates, will provide an attorney’s overview of essential estate planning and asset protection considerations that commonly arise when supporting patients and families through healthcare and long-term planning decisions.

Topics will include advance directives and their role in communicating healthcare wishes, as well as an introduction to wills and the probate process. The session will also examine the differences between wills and trusts, including when each may be appropriate, and discuss how revocable (living) trusts can help families avoid probate.

In addition, the presentation will cover irrevocable trusts used for asset protection planning, including Medicaid Asset Protection Trusts and Credit Shelter Trusts, with practical insight into how these tools may impact long-term care and financial planning.

Learning Objectives

By the end of this webinar, participants will be able to:

  • Understand the purpose and function of advance directives, wills, and trusts in supporting patients’ healthcare and estate planning goals.
  • Recognize the basic steps of the probate process and identify common issues families may encounter following incapacity or death.
  • Differentiate between wills, revocable trusts, and irrevocable trusts, including the advantages and limitations of each planning tool.
  • Identify how asset protection strategies, including Medicaid Asset Protection Trusts and Credit Shelter Trusts, may affect long-term care planning and family financial security.
